Terms of Service

1. Acceptance of Terms

By accessing or using MentalBro ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree, do not use the Service.

The Service is strictly intended for individuals 18 years and older.

2. Description of Service

MentalBro provides digital tools for psychological assessment, mindset analysis, journaling, and self-reflection for traders.

The Service is for educational and informational purposes only and does not provide financial, investment, trading, or professional mental-health advice.

All recommendations, scores, and insights are based solely on self-reported psychological inputs and are not tied to trading performance or financial outcomes.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • maintaining the confidentiality of your login credentials
  • all activity under your account
  • providing accurate information
  • promptly notifying us of unauthorized access

We reserve the right to refuse, suspend, or terminate accounts for violations of these Terms.

4. Subscription & Payment Terms

MentalBro Pro is available as a paid subscription.

  • Subscriptions are billed in advance on a monthly basis
  • You may cancel anytime; access continues until the end of the billing cycle
  • Payments are non-refundable, except where required by law
  • Refunds may be granted only in rare exceptional circumstances at our sole discretion
  • Prices may change with at least 30 days notice
  • Chargebacks or fraudulent disputes may result in immediate account suspension
  • All payments are processed securely through third-party payment providers (e.g., Stripe).

5. Service Availability & Data Integrity

You acknowledge and agree that:

  • The Service may experience downtime due to maintenance, updates, or outages
  • Data loss can occur due to technical failures, user actions, or system changes
  • You are solely responsible for backing up your own data
  • Service interruptions do not entitle you to refunds or compensation
  • We may modify, suspend, or discontinue parts of the Service at any time
  • We make no guarantee of uninterrupted or error-free operation.

6. Data & Privacy

MentalBro processes personal data under the jurisdiction of the Netherlands and is subject to the GDPR.

Data collected may include:

  • psychological assessments
  • mindset scores
  • journal entries
  • self-reported emotional states
  • self-evaluations

MentalBro does not process financial trading data, trading account data, or broker connections.

Mentor Access

If you invite a mentor or share your mentor link:

  • the mentor receives access to your journal entries, psych-scores, assessments, and analytics
  • you acknowledge and consent to this data sharing
  • the mentor cannot access your account credentials

This access remains until you remove the mentor or disable sharing.

We do not sell user data under any circumstances.

7. No Financial or Professional Advice

You acknowledge and agree that:

  • MentalBro does not provide trading advice, investment advice, or financial recommendations
  • All assessments, insights, and messages are psychology-based only
  • Recommendations such as "stop trading," "take a break," or "continue trading" are based solely on psychological self-assessment inputs
  • These recommendations are not tied to your P&L, trading performance, or market conditions
  • The Service is not a substitute for therapy, counseling, or licensed mental-health services
  • All trading decisions remain entirely your responsibility.

8. Acceptable Use

You agree not to:

  • violate any laws or regulations
  • submit harmful, abusive, or malicious content
  • attempt unauthorized access to the Service
  • disrupt or interfere with normal operation
  • reverse-engineer, scrape, automate, or misuse the platform

Violation may result in termination without notice.

9. Intellectual Property Rights

All software, design, logos, content, features, methods, and intellectual property are owned by MentalBro and protected by copyright, trademark, and other applicable laws.

You may not reproduce, distribute, or modify any part of the Service without written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY DUTCH AND EU LAW, MENTALBRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • loss of profits, revenue, or business
  • data loss or corruption
  • financial losses from trading
  • service interruptions
  • inability to access the Service

Liability Cap

In all cases, our total aggregate liability to you shall not exceed the fees paid by you in the previous three (3) months.

The Service is provided "as is", without warranties of any kind.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if:

  • you violate these Terms
  • you misuse the Service
  • you engage in abusive or fraudulent behavior
  • required by law or security concerns

Upon termination, you lose access to all account data.

12. Changes to Terms

We may update these Terms from time to time.

Material changes will be communicated via email or within the Service.

Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in the competent courts of the Netherlands.
